Welcome to ViralV.ai! By accessing or using our website, services, applications, or API endpoints, you agree to comply with and be bound by these Terms of Service. Please read them carefully. If you do not agree to all of these terms, do not use our platform.

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and ViralV.ai. By signing up for an account, purchasing tokens, uploading content, or generating videos, you acknowledge that you have read, understood, and agree to be bound by this agreement.

2. User Accounts & Registration

To access many features of our platform, you must register for an account using Google OAuth:

  • You agree to provide accurate and complete registration details.
  • You are responsible for maintaining the security of your account and credentials.
  • You must notify us immediately if you suspect any unauthorized access to or breach of your account.
  • We reserve the right to suspend or terminate accounts that violate our terms or engage in fraudulent activities.

3. Acceptable Use Policy

You agree not to use ViralV.ai to:

  • Upload, generate, or share content that is illegal, defamatory, harassing, hateful, obscene, or harmful.
  • Upload images or media files without having the necessary rights, licenses, or consent from the copyright holder or individuals depicted in the media.
  • Bypass or attempt to bypass our system limitations, rate limiters, security protocols, or API safeguards.
  • Deploy bots, scrapers, or automated systems that overload our infrastructure or scrape content.

4. Intellectual Property

All branding, designs, source code, logos, assets, template arrangements, and algorithms on ViralV.ai are the exclusive property of ViralV.ai or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any portion of our platform.

5. AI-Generated Content

ViralV.ai provides tools to synthesize, modify, and compose videos using AI models. Regarding AI-generated outputs:

  • You retain ownership of any original source media you upload to our platform.
  • We grant you a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute the final videos generated by you.
  • You are solely responsible for the legal compliance and distribution of the videos you generate. We make no guarantees regarding copyright registrability of AI outputs.

6. Payments, Subscriptions & Refunds

Our billing, subscription tiers, and token purchases are managed via secure payment gateways:

  • Payments are due in full at the time of purchase. Subscription fees are billed on a recurring basis.
  • All token sales, subscription charges, and package payments are final and non-refundable, except as explicitly required by consumer protection laws.
  • We reserve the right to modify pricing, subscription packages, and token allocation rules at any time, with notice provided for recurring subscriptions.

7. Creator Terms

If you upload templates to our marketplace as a Creator:

  • You warrant that you created the template configuration, node scripts, and media structures, or have full rights to license them.
  • You authorize ViralV.ai to display, distribute, and license your templates to other users on the platform.
  • Earnings and payouts are subject to our Creator Payout policies, including minimum balances and transaction processing fees.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ViralV.ai and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or system uptime, arising from your access to or use of the services.

9. Termination

We reserve the right, without notice and in our sole discretion, to terminate or suspend your license to use the platform, block your account, and remove your uploaded templates or generated media, if you breach these Terms of Service or if we suspect malicious activity.

10. Governing Law

These Terms of Service and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the jurisdiction in which the operators of ViralV.ai reside, without giving effect to any conflict of law principles.
